Job Summary:

The Office of the Director (OOD) is looking for a highly motivated individual to join our team as a Assistant Director-General Counsel overseeing the Office of Administrative Legal Services. The Assistant Director-General Counsel acts for the agency under an exemption from Attorney General representation (ARS 36-2903(N)), providing legal services to the agency and overseeing outside counsel. Additionally, they will manage staff attorneys and the agency's Privacy Officer, facilitate administrative rule making, manage a dispute resolution process and the administrative hearing process (including grievances and appeals involving persons with a Serious Mental Illness).

Job Duties:

* Providing legal services to Executive Management and the various divisions and offices of the Agency regarding diverse issues including federal and state legislation and regulations, managed care contracting and procurement, and agency policy; procuring, assigning and reviewing the work of outside counsel.

* Managing and supervising the claim dispute resolution process, the grievance and appeal process for persons with Serious Mental Illness, the scheduling of administrative hearings, and issuing decisions on behalf of the director following administrative hearings.

* Supervising and participating in the process for the adoption of administrative rules relating to eligibility, covered services, provider reimbursement, and managed care contracting.

* Managing the establishment and enforcement of policies and procedures regarding the privacy and confidentiality of individual information as well as responding to public records requests, subpoenas and discovery requests.

* Managing the Office of Administrative Legal Services including budget, personnel, and the review and approval of invoices including invoices from outside counsel.

Knowledge, Skills & Abilities (KSAs):

* Knowledge of the legal aspects of AHCCCS, Medicaid, the Childrens Health Insurance Program (CHIP), and the Health Insurance Portability and Accountability Act (HIPAA)

* Knowledge of federal and state regulations concerning health care programs, administrative procedure, procurement, contracts, state and federal financing, due process

* Understanding of the responsibilities of state regulatory agencies and channels of decision-making authority

* Ability to conduct legal research in a highly regulated environment.

* Oral and written communication skills

* Ability to identify complex legal operational, and programmatic issues

* Ability to communicate effectively with internal staff, external entities and stakeholders at the agency, state, and federal levels

* Ability to exercise sound judgment in making decisions and providing advice in highly technical areas often involving ambiguity

Selective Preference(s):

* MPH, MBA, MPA or other relevant Master's degree

* Five to seven years of experience in the practice of law, including litigation, health care law, contracts and tort law that includes two years of managerial or supervisory experience in an administrative law environment or private law firm.

Pre-Employment Requirements:

Licensing requirement: Admission with good standing to the Arizona State Bar or eligible for admission based on motion under Arizona Supreme Court rules 34(f) or 38(a).
